Data and purposes
We process account and contact details, boat profiles and dimensions, stay dates, passenger counts, expected arrival times and updates, special requests, messages and request decisions. These data allow us to handle requests and communicate changes by email and within Berthly. We process insurance and registration files only if you upload them, and share them with the marina when you select them for that request. Technical and access records support troubleshooting and service security.
Legal bases
Account and request processing is necessary to provide the requested service and take pre-contractual steps. Security and abuse prevention rely on legitimate interests, balanced against your rights. Records required by law are processed to meet legal obligations. Any optional marketing requires a separate choice; accepting the terms is not marketing consent.
Recipients and providers
The marina receiving your request receives the contact, boat, stay and document information you select. It is responsible for its own use of that information. Berthly uses Base44 for application services, Supabase for private document storage, Google Gmail for operational email and Mapbox for map delivery. Map requests can transmit technical connection information to the map provider.
Location and international processing
The configured Supabase project is in Ireland. Other providers may process information outside the European Economic Area. Applicable transfer safeguards and provider arrangements must be observed; an EU storage region does not mean every service operates exclusively within the EU.
Retention
Account and boat data are retained while needed to provide your account. You can remove optional documents. Request and audit records may be retained where needed to handle the request, disputes, security incidents or legal duties. Retention is limited by those purposes; deletion requests are assessed against any legal need to retain particular records.
Your rights
You may request access, correction, erasure, restriction or portability, and object where applicable, by writing to giacomo@getberthly.com. Where consent applies, you may withdraw it without affecting earlier lawful processing. You may complain to the Spanish data protection authority, AEPD, at www.aepd.es.
Choices
You can explore without uploading documents. Providing accurate boat and stay details is needed to make a useful request. The privacy notice explains processing; it is not a request for blanket consent. Contact us before uploading information about another person if you are unsure you may share it.
Location and browser storage
When you select “Use my location”, your browser requests permission to obtain your position. If allowed, Berthly sends the coordinates to its search service to find nearby marinas and calculate indicative distances. You can deny or withdraw browser permission and continue searching the map. The browser stores session information, language, recent searches and search and map preferences using cookies or local and session storage. Clearing these data may sign you out or reset preferences.
